EAK Service and Usage Terms

1. Purpose and Scope

These Service and Usage Terms (the “Usage Terms”) govern the technical and operational rules applicable to the information technology, hosting, server, network, e-mail and related services provided by EAK Elektronik Bilgisayar İnternet ve İletişim Hizmetleri Sanayi ve Ticaret Limited Şirketi (“EAK”).

These Usage Terms form an integral part of the EAK General Service Agreement.

By using EAK services, the Customer agrees to comply with these Usage Terms, EAK’s Acceptable Use Policy (AUP), the technical specifications of the applicable service package and all applicable laws and regulations.


2. Service Packages and Technical Specifications

Technical specifications applicable to each service may include:

  • CPU,
  • RAM,
  • disk capacity,
  • disk type,
  • disk I/O,
  • inode limits,
  • traffic,
  • bandwidth,
  • IP addresses,
  • e-mail sending limits,
  • backup scope,
  • operating system,
  • licences,
  • control panels,
  • support level.

Such specifications shall be stated on the relevant product page, order screen, quotation or service-specific terms.

EAK determines technical limits on a per-service or per-package basis rather than fixing them permanently in this document.

The Customer is responsible for using the service within the technical limits of the purchased package.


3. Shared Hosting Services

Shared hosting services are services in which multiple customers use common physical or virtual infrastructure resources.

The Customer may use the hosting account primarily for:

  • websites,
  • web applications,
  • e-mail,
  • related web services.

Unless expressly permitted by the applicable package, a hosting account may not be used primarily as:

  • a general file archive,
  • personal backup storage,
  • external data storage,
  • video or file distribution infrastructure,
  • infrastructure for unusually resource-intensive applications.

Where a hosting account causes excessive CPU, RAM, disk I/O, inode, process or connection usage and adversely affects other customers on the same platform, EAK may temporarily limit resource usage.


4. Hosting Resource Limits

Technical limits applicable to hosting services shall be determined according to the current specifications of the relevant package.

Such limits may include:

  • CPU usage,
  • memory usage,
  • disk usage,
  • disk I/O,
  • inode count,
  • concurrent process count,
  • database resources,
  • e-mail sending limits,
  • bandwidth.

Where the allocated resources are continuously or abnormally exceeded, EAK may:

  • notify the Customer,
  • temporarily limit resources,
  • recommend an upgraded package,
  • temporarily suspend the account where necessary to protect other customers or platform stability.

5. Hosting Backup Policy

Whether backup services are included and, where applicable:

  • backup frequency,
  • retention period,
  • restoration scope,
  • number of restorations,
  • restoration fees,

shall be stated in the relevant hosting package.

Internal system backups taken by EAK for infrastructure security or disaster recovery purposes shall not constitute a guaranteed Customer backup service unless such service is expressly included in the relevant package.

The Customer should maintain independent copies of critical files and databases in a separate environment under the Customer’s control.


6. Website Migration Service

EAK may assist with migration of a Customer’s website from another provider to EAK infrastructure where included in the applicable service.

Successful migration may depend on factors including:

  • access to the former server,
  • control panel compatibility,
  • software used,
  • database structure,
  • file permissions,
  • technical restrictions imposed by the former provider.

EAK shall exercise reasonable care during automated or manual migration but does not guarantee a flawless migration where limitations originate from third-party systems.

The Customer is responsible for verifying the website, databases, e-mail accounts and other functionality after migration.


7. E-Mail Services

Hosting and corporate e-mail services provided by EAK may not be used for spam or unauthorised bulk messaging.

E-mail sending limits shall be determined according to the applicable service package.

The Customer may not send unsolicited commercial messages to:

  • purchased mailing lists,
  • unauthorised databases,
  • bulk recipient groups for which valid consent has not been obtained where required.

Where an account is detected as being used for spam, malware distribution or unauthorised bulk sending, EAK may temporarily restrict outbound e-mail or SMTP ports.


8. VPS and VDS Services

For VPS and VDS services, virtual resources specified in the purchased package are allocated to the Customer.

Resources may include:

  • CPU,
  • RAM,
  • disk,
  • network capacity,
  • traffic,
  • IP addresses.

EAK may migrate a virtual server to another physical host for purposes including infrastructure maintenance, performance balancing, hardware renewal or capacity management.

Where reasonably possible, the Customer shall be notified in advance of planned migrations.


9. Managed and Unmanaged Server Services

Unless expressly stated otherwise, VPS, VDS and dedicated server services may be provided as unmanaged services.

For unmanaged services, the Customer is responsible for:

  • operating system administration,
  • updates,
  • firewall configuration,
  • installation of applications and services,
  • user accounts,
  • password security,
  • database administration,
  • software security,
  • application-level backups.

For managed server services, the scope of EAK’s responsibilities shall be stated in the relevant service package or separate service agreement.


10. Dedicated Server Rental

For dedicated server rental services, the hardware configuration stated in the relevant order or quotation is allocated to the Customer.

Technical specifications may include:

  • CPU,
  • RAM,
  • disk,
  • RAID,
  • network connectivity,
  • traffic,
  • IP addresses.

In the event of a hardware failure, EAK shall take reasonable steps to repair or replace the affected hardware component within a reasonable period.

Software-related issues, Customer configuration errors or data loss caused by software changes shall not be treated as hardware failure.


11. Colocation Services

Under colocation services, physical equipment owned by the Customer may be hosted in EAK facilities or in a data centre used by EAK.

The following conditions shall be specified in the relevant quotation or special agreement:

  • rack space,
  • power,
  • network connectivity,
  • traffic,
  • IP allocation,
  • remote hands,
  • physical access.

Equipment delivered to the data centre must be technically and physically suitable for installation and operation.


12. Disk Usage and High Write Workloads

Where SSD, NVMe or other flash-based storage is used, unusually high and sustained write workloads may negatively affect storage health or shared infrastructure performance.

Where such usage threatens hardware health or the quality of service provided to other customers, EAK may contact the Customer and recommend an appropriate technical solution.

Where necessary, EAK may apply resource limitations or require migration to a more suitable service.


13. Network Traffic and Bandwidth

Available network traffic and bandwidth shall be stated in the applicable service package.

Where a traffic quota applies, excess usage may result in:

  • additional charges,
  • bandwidth limitation,
  • purchase of additional traffic.

The applicable method shall be stated in the relevant service specifications or order terms.


14. IP Addresses

IP addresses allocated by EAK grant a right of use only for the duration of the relevant service.

IP addresses may be changed for technical, operational, security, routing or regulatory reasons.

The Customer must not cause allocated IP addresses to develop a negative reputation through activities including:

  • spam,
  • phishing,
  • malware,
  • attacks,
  • botnet activity,
  • unauthorised scanning.

15. RBL and IP Reputation Policy

Where spam or abuse originating from a Customer causes EAK-owned IP addresses or prefixes to be listed on significant RBL or reputation systems, EAK may take necessary technical action.

Such action may include:

  • blocking SMTP ports,
  • disabling an affected IP address,
  • traffic filtering,
  • temporarily withdrawing announcement of an affected IP prefix.

These measures are taken to protect EAK infrastructure and other customers.


16. DDoS and Network Attacks

Where a DDoS, flood or similar attack directed at a Customer adversely affects EAK infrastructure or other customers, the relevant traffic or IP address may be temporarily filtered.

Where necessary, EAK may apply a null route to the affected IP address or temporarily isolate the service.

Unless the Customer has separately purchased a specific DDoS protection service, EAK does not provide an unlimited attack-mitigation guarantee.


17. Abuse Notifications

Where EAK issues a serious abuse notification, the Customer must respond within the time stated in the notification and take the necessary corrective action.

Shorter response periods may apply in urgent security incidents.

Where the Customer fails to respond or the violation continues, the service may be:

  • restricted,
  • temporarily suspended,
  • terminated in cases of serious or repeated violation.

18. Prohibited Use

EAK services may not be used for unlawful activities.

Prohibited activities include, without limitation:

  • phishing,
  • malware distribution,
  • botnet operation,
  • unauthorised spam,
  • unauthorised system scanning,
  • brute-force attacks,
  • DDoS attacks,
  • IP spoofing,
  • distribution of pirated or otherwise unlawful content,
  • activities infringing third-party rights,
  • unauthorised cryptocurrency mining,
  • unauthorised attempts to access other systems.

More detailed usage restrictions are set out in the EAK Acceptable Use Policy.


19. Cryptocurrency Mining

Cryptocurrency mining and similar activities causing sustained high CPU or GPU consumption are prohibited on shared, VPS or other shared-resource systems unless expressly permitted by the applicable service package.

Use on dedicated or otherwise exclusively allocated systems may be subject to separate service and infrastructure policies.


20. Technical Support Channels

The official channel for technical support requests is the EAK customer panel or support ticket system.

Telephone, messaging applications or other channels may be used to:

  • report an urgent situation,
  • inquire about the status of a support request.

Technical operations, findings and resolution steps should, where reasonably possible, be documented through the support system.

This approach helps maintain a technical record for both the Customer and EAK.


21. Scope of Technical Support

Standard technical support is generally limited to:

  • availability of EAK infrastructure,
  • service activation,
  • control panel access,
  • network access,
  • core services provided by EAK.

Issues relating to Customer-controlled items may fall outside standard hosting support, including:

  • website software,
  • plugins,
  • custom applications,
  • software development,
  • SQL optimisation,
  • third-party software,
  • end-user desktop issues.

EAK may provide managed services or professional support for such matters on a separately agreed or chargeable basis.


22. Security and Customer Responsibility

The Customer is responsible for taking appropriate security measures, including:

  • using strong passwords,
  • keeping software up to date,
  • disabling unnecessary services,
  • configuring user permissions appropriately,
  • remediating security vulnerabilities.

Where a compromised Customer account causes spam, attacks or other abuse, EAK may temporarily intervene to protect the network.


23. Scheduled Maintenance

EAK may perform scheduled maintenance for infrastructure security, stability and performance.

Where reasonably possible, planned maintenance shall be announced in advance.

Short-term service interruptions may occur as a result of activities including:

  • host migration,
  • network changes,
  • software updates,
  • hardware maintenance.

24. Emergency Intervention

EAK may intervene without prior notice in the event of:

  • a critical security vulnerability,
  • hardware failure,
  • an active attack,
  • any condition threatening infrastructure integrity.

Where appropriate, the Customer shall be informed after the intervention.


25. Domain Name Services

Domain name registration, renewal and transfer procedures are subject to the rules of the applicable registry or registrar.

Availability of a domain name at the time of order does not constitute a final guarantee of successful registration.

Once a domain name has been registered, cancellation and refund conditions of the relevant third-party provider may apply.

For .tr domain names, TRABİS rules and applicable Turkish regulations shall apply.


26. SSL Certificates and Software Licences

SSL certificates and third-party software licences are subject to the licence and usage terms of the relevant provider or manufacturer.

Changes made by third-party providers to prices or technical terms may be reflected in the relevant service upon renewal.


27. Suspension of Service

EAK may temporarily suspend a service in cases including:

  • serious resource abuse,
  • security threats,
  • spam,
  • attacks,
  • malware,
  • late payment,
  • unlawful use,
  • violation of the AUP.

Where immediate intervention is not required, EAK shall endeavour to provide the Customer with a reasonable period to remedy the violation.


28. Data Deletion

Data associated with expired or cancelled services may be deleted after a period determined according to the applicable service retention policy.

EAK is not required to retain Customer data relating to expired services indefinitely.

The Customer is responsible for exporting any required data before the service terminates.


29. Service Level and SLA

Unless a separate written SLA is provided, no specific uptime percentage shall be deemed guaranteed for standard services.

For corporate or custom services, matters including:

  • uptime,
  • response time,
  • support level,
  • resolution time,
  • service credits,

may be governed by a separate Service Level Agreement.


30. Compliance with Law

The Customer is responsible for using EAK services in accordance with the laws of the Republic of Türkiye and any other applicable legal requirements.

Duly issued decisions and requests of competent authorities shall be processed by EAK in accordance with applicable law.


31. Relationship with Other Documents

These Usage Terms shall be applied together with:

  • the General Service Agreement,
  • Acceptable Use Policy,
  • KVKK Privacy Notice,
  • Privacy Policy,
  • Cookie Policy,
  • Cancellation, Refund and Withdrawal Policy,
  • service-specific quotations or agreements.

Where specific terms apply to a particular service, those service-specific terms shall take precedence for that service.


32. Amendments

EAK may update these Usage Terms due to:

  • technological developments,
  • changes in service infrastructure,
  • security requirements,
  • changes in applicable law or regulation.

Changes materially affecting existing Customer rights shall be announced in accordance with applicable legislation.


33. Entry into Force

These Service and Usage Terms were last updated on 9 September 2026.

By ordering or using EAK services, the Customer accepts the provisions of these Usage Terms applicable to the relevant service.

Language and Interpretation

This English version is provided for the convenience of international customers.

The original language of these Service and Usage Terms is Turkish.

In the event of any discrepancy, inconsistency or difference of interpretation between the Turkish and English versions, the Turkish version shall prevail, to the extent permitted by applicable mandatory law.
